If Joe Bloggs has caused the damage by his negligence, and he did so in the course of his employment by Company C, then Company C is vicariously liable for Joe Bloggs negligence. Joe Bloggs is not employed by Company A, Company A appears to have sub-contracted the job originally to Company B. So on what basis in law could Company A be liable for the negligence of Joe Bloggs, who has no relationship to Company A whatsoever. My apologies to anyone on the boardroom who may bear the name of Joe Bloggs! Scott, this is my last word on the matter, I just don't want you to waste your money on suing the wrong party, based on "legal" advice from people who may not have any legal qualification.3 points

Westfield SEIGHT 1996 Factory build as a modified production car for Tim Coventry and Tim Mason to take on the British Hill Climb Championship by the Westfield Factory broke a number of records. Purchased in 1999 by Ian Stinton and Neil Clark for the British Hill Climb Championship and British Sprint Championship again very successful, 1st Modified Production car to qualify for the top 10 run off BHC (they then changed the rules), suspension setup done by the late and great Alan Staniforth. JE Development 5.0l V8 Rover Engine with 375BHP, Full Motec ECU and electronic control, Engine rebuild in 2006 less than 1 hours running since. Did hold alot of records and many FTD awards some of the older members will remember. The ground shook when it was on the startline. Spare discs Sierra rear calipers with drilled / vented discs Instrumentation Stack ST8130 Digidash Plus with full parameter recording and lap timing DTA ECU providing traction control (on/off) and wet or dry; launch control Four wheel sensors for above. ECU accessed via DTA windows 10 software; RS232 interface and βdyno boxβ to control during engine run. DTA ECU timing settings slightly changed from original to ensure running on 95Ron petrol - can easily be adjusted by laptop - I have Linx1010 set up to access ECU via RS232 and all connecting cables and intermediate rare dyno box - can be included in the deal. Builder believes change was unnecessary and 350BHP available. Has traction and launch control with the ecu. This car is seriously quick. But itβs super smooth so can be driven very calmly and is very comfortable for long distance touring. If you press the loud pedal it gains speed very quickly, pulls very strongly and will embarrass just about anything you are likely to come up against. The engine does rev very freely, it is definitely not a dull V8 by any means. The car will be supplied with 12 months MOT, Iβm confident that this is one of the best built Seights out there and got to be one of the quickest Westfields on the road! And strictly in the realms of "I wonder if..." it was mentioned to me a while ago that whilst liability waivers/indemnities are all very well, it may be that the driver/participants can only waive their own rights. The example was that if a spouse was injured during a track day, whilst the injured party had waived liability, the spouse had not waived any such rights they might have to seek recompense. So when a waiver/indemnity is signed, just how far does it "reach"? What if a household suffered significant loss as a result of an incident and decided to go after the individual rather than the the organisers or event hosts? I'm sure the family of the unfortunate passenger in that Beemer are looking at their options, especially as the vehicle was observed driving erratically and seemingly breaching safety guidance. Remember the waiver is to indemnify the track and organisers from being liable, not from passengers or spectators going after other individuals who might be deemed liable, as I understand it... Maybe things have changed or maybe the person telling me was just plain wrong, but it made me think...1 point
