My brother has been contesting a speeding offence for several months. 10th letter back from the police yesterday. They have actually moved onto non speeding issues like insurance and drivers license as they have realised that he won't confess. Basically the law still says that you need to provide the names of all possible drivers - rest is up to them to prove still. They will continue Search hamiltons and you will find they were let off because he said she was driving and she said he was driving and there was no way of proving in court. I'm no legal expect but the burden is still on them to prove that you were the driver - the NIP is just what it says. You will get many many threatening letters but the law is still in your favour - just that most people incriminate themselves by returning the NIp saying that they were driving. They were trying to change the law to automatically prosecute the registered keeper to overcome this issue but this fell through for obvious reasons. The simple fact is that if everyone sent an NIp from a speed camera contested rather than convicted themselves the crazy system would collapse in weeks under an administrative and court backlog. Essentially he just ignored most of their NIP's as they were'nt sent by recorded delivery. Asked for the calibration proceedures and certs for the machines. ( Separate letters!. Had two apologetic Policemen on his door, but when he asked them for their evidence they went away. In the end they gave up! As David says the onus is on the authorities to prove that you were driving when the offence was recorded and that their evidence stands up to scrutiny. Pal who works for West Mids says they normally give up after the third letter as the cost outweighs what they get in fines. My company is currently being prosecuted for failing to name the driver of a van caught "speeding". Fine could be £1000. To date, despite requests the court has failed to provide us with enough evidence to enable us to identify the actual guy of the three on board who was driving the van. Needless to say the individuals involved "can't remember". If they can't get their money one way, then they will try another. Quote

nlash Posted February 20, 2005 Posted February 20, 2005 They cant prove that you ever received the FPN, After a couple of attempts the authorities usually send a 14 day demand by recorded delivery. If they have your name spelt incorrectly ignore the FPN until they get it right. Then claim you have never received the notice. When the postman tries to deliver a recorded delivery 14 day notice, if the name is STILL incorrectly spelt, refuse to sign for it and ask the posty to arrange for the notice to be returned to sender as undelivered. This can legally go on until they get your name spelt correctly. I can assure you, they will give up after 3 months and you may very well have got away with it. Quote

ISTR the charge for using a laser jammer was 'obstructing a police officer in the course of his duty'. If all the van ops are civvies will this charge still stick ? Quote
Mat Jackson Posted February 21, 2005 Posted February 21, 2005 Ok, soory to rant but here goes. I speed, but I know I shouldn`t. However it does annoy me when people get caught and moan about it. You may have only been braking the law a little bit, but it was still breaking the law. If you were speeding, don`t contest it, hold your hand up and take it on the chin. As for the coments about the police catching propper criminals, the stats do show that excessive speed and bad driving contribute to far more injuries and deaths than any other cirmes by miles. So if you want to make a difference then target drivers. Sorry to rant. Like I said I do speed, I have no problem with other people speeding, just don`t moan when you get caught. Quote

What did pee me off lat year though was when I saw two traffic cops blattently racing each other as they left the HQ in West Wales. I admit iot is sometimes one rule for them and another for us!!
