Potholes, car damage and making a claim

I got no where with my damage and gave up after a year of emails.  the only way forward is  with a solicitor. and that will cost you and they know it. :no:

Tried and failed when I did some damage last year, about a dozen letters back and forth, maintenance reports etc etc, complete waste of time.

If I can find the last letter I sent them I'll post it up, made me chuckle through gritted teeth.

 

FWIW the wheel may be repairable. Sure there will be a specialist in your area.

 

Good luck but I fear you'll be wasting your time...

yeah i agree but its just sounds like a hiding to no where.

 

maybe we should be a little more proactive and all start sending the council a letter every day. I looked at the liverpool page for it, there is a nice online form where you put in the street and location and a nice ambiguous box saying "how can we find it". the only problem is you have to put your name and email. i thought i would send a form in for every hole on the way to work today but i lost count while trying to avoid the holes and bikes and kids etc at 30. i also thought that if i filled it in every day for the 30 i would get no work done and probably get reported for some sort of mail spamming harassment thing.

Dom if the hole exists then you are doing a public service by reporting it.

 

During my 2nd claim, the council said they can show records that prove that section of road is inspected regularly, it's the A62 main Oldham to manchester road. I said fine send me copies of those reports going back say 40 years cos' this is the time i have regularly driven up and down this road, I also on a weekly basis took photos on my digital camera, (which shows time and date), of potholes for a 1/4 mile either side of the one that caused the damage, Just in case i needed proof of the amount of time they had been there. I didnt need them cos when i said send me back the original bill for the damage (I had to send it in with the claim) I will need it to take to the small claims court to support my claim, they paid up. As Adrian says persevere!

I was sent a snotty letter from there insurers with some case law ,explaining that basically it was get out off jail free for them. :no:

if I could find it I will  post it on here :angry:

i think your better rephasing that by saying

its something i keep thinking about but never remembering to do. i crash to work (not in a guest sence) over the bumps thinking and moaning to myself at the potential damage to the car but never say anything about it. so im going to send a new one in every day. the form is quick to do.

Just been a piece on this on the One Show small claims court and check that the pothole has been reported and the council have not fixed it. That may help.

...which is why you should report potholes via the likes of FixMyStreet.co.uk - that way you (or others) can demonstrate the council knew about it and did nothing.  It's surprisingly effective of getting them filled too.

Went past the offending hole today and it has been filled. I reported the pothole via northants street doctor website the morning after.

Went to look at the damage a bit closer today, at first I thought the tyre was ok and the bead had just come away from the rim but on closer inspection it appears there is a large hole where the tyre has been pinched between the rim and hole.

The council today acknowledged my request for the highway agencies inspection reports on the road for the past few months.

New wheel arrives tomorrow morning so will start getting my paper work together to submit my claim.

We got something similar so looked it up. The one we were quoted was about consequential loss, so we wrote back explaining all of our claim was for direct loss and damage and that since we were not attempting to claim consequential loss the case did not apply. In our case the key point was did the council know. Our pictures taken and dated the next day showed the existing markings where the council had marked the hole for repair a few weeks beforehand.

Received some good news in the post today, the council have paid out for the cost of my replacement wheel, only took 3 months!

That's about normal, you have to persevere, if you give up you get nout, well done :t-up:
