Perhaps I'm missing the point - you didn't get a ticket, right?

So why the fuss?

Your car is probably noisy, so they probably did hear you coming and thought they'd stop you as a bit of a warning. No doubt they were there because of whinging locals and were just making themselves be noticed.

Forget about it and move on, they really won't take your car unless you deserve it. I've been stopped three times in one day in the same car for a ticking off, twice was the same copper, and I still have the car, no one took it. Plus, I was driving like a d**k and you weren't. I think you'll be OK. :)

The problem is the fact that a section 59 can cause heaps of trouble if he is stopped again. It will flag up against the reg number and could potentially mean the car being impounded.

It only takes another of zealous copper to be a pain in the  :arse: with a point to prove!

I take it from one of the posts there is a problem with 'boy-racers' in the area?

You also have to understand there are more people that 'detest' cars and motor bikes than actually like them in the general public.  :(

(We are biased here because we are car enthusiasts).

Perhaps the people in the village have been constantly calling the local Police complaining about the cars driving through the village at great speed (Do the Police act on their complaints or side with the car enthusiast the General public assume a noisy car is travelling above the speed limit - you have to appreciate the other side of the arguements as well.)

Lets imagine that someone is lying in bed with their curtains shut in the little village you were driving through; does it matter to him/is there any difference between the noise coming from your Westfield or the Local Corsa Boy?

As said - you didn't get a ticket just a warning that your car is loud and you need to be careful about the noise it makes driving through a built up area.

By your own admission you had broken the speed limits in the built up areas; don't do it again and quieten the exhaust; there will be no problem then.

Police get criticised if they are doing their job or not doing their job - is there any way they can win.

Is it not the back bone of our society that they should NOT discrimanate against groups of people (Why should you get preferential treatment over a youth in a Corsa, should a white man be treated differently from a black man?) - hence we should all be treated the same - that is fair.

Sadly in modern life that doesn't always happen though does it   ???

Remember the incident with the speeding shropshire policeman only too well     ;)

But agreed it *would* be nice to all be treated the same...

Yeah but the boys inblue can't even operate that principle within their own ranks.....

For example it appears only chief constables and above get free weekend spa breaks at top resorts.... :laugh:  :laugh:  :laugh:  :p

Well ive not had anybody contact me......didnt expect it really

Its good that we can all share our opinions and advice on here and i appreciate the help greatly.

If I had been done for speeding then fine, Ive only ever been done once before and that was 18 years ago for doing 33 in a 30. I was going too fast, got caught, paid the fine and lived with it. But as for yesterday, I want to know what im supposed to have done wrong exactley.

I returned home, showered and went to bed and it wasnt until I posted this morning I became aware of the nature of the S59. Id never heard of it before. Its the seriousness that bothers me, how can I honestly say that im going to drive the Westy without speeding in the next 12 months?

It's minor, it's only when I read John's post that I put 2 + 2 together, which is good if the issuing of section 59's has stopped the few charging around.

I shall keep my own thoughts about the boys in blue to myself.

How is it recorded?

How can they be sure someone else hasn't cloned your car's id?

How can they prove they issued one?

How can they prove they actually stopped you and didn't just decide to issue one to a random car as it drove past?

Surely if you don't get a copy of anything then it's utter and total fabricated bullsh*t scare tactic b*llocks?

A S.59 is a warning - it's being blown out of proportion - as long as you behave over the next 12 months there isn't a problem.

(Also be aware a S.59 notice applies to both vehicle and the person - if you were found using another vehicle in an anti social manner that vehicle you are driving can be seized as you have the S.59 notice on your person; likewise if another person drives your Westfield in an anti-social manner the westfield can still be seized)

It won't get crushed - you will just have to pay £150+ to get it back.

It can be verbally issued although my force actually visits and delivers a 'piece of paper'.

Hopefully the proof is the two Police officers - fortunately the Courts do still believe the word of two Police officers; although they no longer believe the word of One officer over the local Toe rag in a large number of casses.

Still way OTT.  WAY.  It's preposterous.  So you can gather 11 points on your license for driving like an absolute knob and still drive, get another point and get your license suspended but still keep your car, but drive a car that makes a legal level of noise twice in twelve months and get it confiscated? He could have got a warning that wasn't a 59. Serve no useful purpose whatsoever.

.............wasn't this officer taken to Court by the Police  ???

.....Therefore he has been treated the same?

Don't accuse the Police of discriminating when they have dealt with an Officer in the same way as anyone else - If the CPS or Courts decide not to prosecute then that is not a Police matter surely?
