GALLY Posted July 22, 2011 Author Posted July 22, 2011 They said that they heard me coming, but it was at 21.50. They had just pulled a boy racer as ive said, I couldnt have been far behind as they stepped into the road and pulled me (without the gun). I couldnt be done for speeding but they asked all the usual questions, I thought that they were going to let me go. The officers had a chat together for a couple of mins and said that they were to 'section 59'me and explained my car is likely to cause, alarm, distress or annoyance to members of the public. I should have asked more questions, I was a little surprised as I expected a producer at the most. But now im driving a yellow car in a small town (Lichfield, sposed to be a city) and am going to stick out like a sore thumb. From what I now understand if the car is involved in any motor offence in the next 12months then I loose it. The car is noisy but not load, not compared to a xflow. I well P*ssed off!!!!!!
s2k7 Posted July 22, 2011 Posted July 22, 2011 yeah.....a bit harsh worse they used radars & cameras, soon they will write tickets based on sense of sight, smell, touch and hearing. Oh! watch those dougnut patrols having a constant break. Never bother them while eating. They will write ticket based on taste. So, keep those silencers silent.
cast iron Posted July 22, 2011 Posted July 22, 2011 did you know that two plods together who see you dont need a speed gun to estimate your speed and if they agree they can do you for speeding based on there joint opinion oh and of course superb training in such matters
Captain Colonial Posted July 22, 2011 Posted July 22, 2011 Thinking about this, if there's anyway you can do it, I'd get some help and a noise level meter and measure the dB from the same spot while you drive at 40 mph. Then I would call and make an appointment to go and see the supervising officer to discuss the matter. Why you were given a 59 needs clarifying, and frankly should have been clarified at the time, not just general. If it was noise, you can at least say what the dB level is, show a current MOT, explain it isn't louder than thousands of other 7s on the road, and ask the 59 to be rescinded. Absolutely b****y ridiculous that you have to do so, though.
Ian Podmore Posted July 22, 2011 Posted July 22, 2011 Hi John, this is not good news! I suspect that they have been issuing a load of these to the local spotty hot hatch brigade as I've not been hearing them tearing round at night for a few months now. They used to drive like loonies between the 'Screwfix' island and Kwik Fit, but not anymore. Everynight someone was taking his CTR to the max down there. Can't our local plod tell the difference between a proper sports car and a jumped up hot hatch driven by a kid who wants to spend his evenings in McD's car park and driving around town anymore? It may be worth trying to speak to a sergeant to appeal to someones better nature and explain that you weren't just driving around making a nuisance, you weren't driving carelessly (or off-road!), and especially to point out that you now feel very uneasy about driving your pride and joy as you were pulled when doing nothing wrong, and not intending to do any wrong. Also how you detest people racing round in their hot hatches etc. Good luck, hope family is well. Ian

Paul Hurdsfield - Joint Manchester AO Posted July 22, 2011 Posted July 22, 2011 and especially to point out that you now feel very uneasy about driving your pride and joy as you were pulled when doing nothing wrong, and not intending to do any wrong. But he did admit to doing nearly 40mph in a 30 zone Our cars attract a lot of attention at the best of times, lets not give them any more reasons to be watching out for little yellow kit cars. Out on the open road fair enough but 30mph is usually a built up area.

Whilst we attend, someone somewhere might actually really be needing us .. especially as a result of a boy racer .. ..
carpetstu Posted July 22, 2011 Posted July 22, 2011 John, I have just confirmed that a section 59 is well out of order. A mate of mine is a traffic officer and she can not see any reason why this was issued, and she does know your car very well! You have the info from my phone call I hope the Sargent can help you sort this rubbish?
Gadget Posted July 22, 2011 Posted July 22, 2011 I now use my racelogic camera system every time I go out on the road. It does mean that I have to be extra carefull myself as it shows my speed and G force overlaid onto the video. There are two cameras on the system, one showing the road ahead and one looking over my shoulder and giving a view of how much steering input and when I change gear. Never had to use it yet, but it is an insurance to avoid incidents similar to previous posts.
GALLY Posted July 22, 2011 Author Posted July 22, 2011 Just been to the Station and apparently there isnt a sergeant on until 6pm. It only happens to be the same gentleman that I had the pleasure of meeting last night. He is going to call me later..............at least I may get a better explanation if nowt else.
stephenh Posted July 22, 2011 Posted July 22, 2011 A vehicle seized under section 59 is not necessarily destroyed. The lawful owner can recover it on payment of a fee. I think it is £150 minimum for a car.
adamnreeves Posted July 22, 2011 Posted July 22, 2011 You hooligan. No seriously I think it has been said. Take a sound reading of your exhaust. Go to the cop shop and see some one in authority and voice your concerns. The fact is the only reason you were given was an off the cuff unqualified remark, "We heard you coming". Now to me this suggests that they did not see you coming and if the didn't see you then how do they know the noise was coming from you. Do a noise test. I would keep it constructive because you only want to avoid getting another one at least. Maybe explain that you were not part of that group and was just passing, not that they'll listen I suppose.
perksy Posted July 22, 2011 Posted July 22, 2011 Gawd can it get any worse The boys in Blue putting us in the same class as the Drum & Basssss boys on their way down to the local Krooz John I think you were just in the wrong place at the wrong time mate Hopefully this can be sorted out sensibly If not i'd be writing a nice letter to the chief constable for a start Having heard your westy i really don't think its that loud Maybe they didn't like all the carbon fibre
