As a road user you should always drive to allow yourself time to stop in any conditions (in the eyes of the law). I'm not saying it's your fault - it's a accident that neither of you could have stopped, but I would imagine that the insurance companies will call it a 50/50. If some-one posts up a good argument for it being your fault (or some other argument that is disadvantageous to your position), and some-one with an "interest" in the claim is looking, you may have a load more trouble than you're expecting... FWIW, I had reason to claim a few months ago and Footman James sorted it all out in a speedy and professional manner, the most that is at risk is paying the excess if you are comprehensively insured.
