I think he had an independent inspection too but only a quick one - he gave up on a full inspection as it was clear nothing was going to come of it. But if it's a metalurgical issue they probably aren't going to spot it anyway. No harm in trying everything you can - you may get on better than he did. But start looking for a second hand engine asap. Didn't stop him selling it after about 6 months and buying another new one. Mike Quote
MGF255 Posted November 13, 2011 Posted November 13, 2011 It may be well worth contacting the citizens advice bureau because the EU warranty laws protect you a lot maore than any manufacturer will admit to. The way I see it even if you don't get a result from them it hasn't cost you anything. Drop them an email or phone call outlining the full circumstances. I worked in retail and if you knoew the law and your rights you got a quick and satisfactory resolve than if you didn't or wasn't willing to take it to the authorities. Good Luck If there was a component defect would it have lasted 117k miles before letting go I have to agree a second hand engine would be the cheapest option because if the dealer strip the engine , send it off for component testing and it turns out to be outside the terms of warranty then you will be liable for the cost of labour . He had his car inspected by an independent 'engineer' and he claimed it was due to turbo failure filling the engine with oil and then hydraulicing. He was never convinced though as the garage that did the last service had already dismantled a lot of it before the inspector turned up In the end it cost him £4k+. If the car hadn't have been just over 3 years old he would probably have scrapped it. Mike Quote

A few bar room barristers seem to think that a case similar to this was judged against the manufacturer on the basis that the car must have a service life after warranty ends and that a catastrophic failure that effectively rights a car off at dealer costs is totally unnacceptable . I am not sure on the detail , but understand that the circumstances are similar, and while I realise that doesn't stack up to a great deal it is a line of investigation to follow. More will come to light I am sure Quote
Lurksalot Posted November 19, 2011 Author Posted November 19, 2011 A quick update , but as at close of play today , it would appear that VW are providing a new lump FOC and it is to be fitted by the dealer for labour of £880 . seems a bit steep for the fitting but overall a reasonable result we tend to think , I will confirm it actually happens as discussed when he drives it home Quote
