Will try and keep this brief.........

SWMBO purchased a car parking ticket in a council run carpark. This ticket was stuck to the driver side window and SWMBO left the car (with the 2 kids).

On returning to the car a fixed penalty notice was on the windscreen. The parking ticket had come unstuck and was in the drivers footwell.

It was a warm day, we can only persume the ticket became unstuck.

SWMBO appealed the £25 fine...... this was declined.

I then appealed again.... this was declined and the fine went to £50.

I appealed again on the understanding this would go to a tribunal.

The Tribunal hearing was last week. I apealed as i had a valid ticket, that was still in its paid time at the time of the notice and it was unfortunate that the ticket fell off the window.

The Judge, said i should have put the ticket on the windscreen, so in the event of it falling it would still be seen. I contested this, as it could have fell face down and still resulted in a penalty.

I was told it was "my" responsibility to ensure the ticket is dispayed at all times. I answered this was un reasonable as I would have to stay with my vehicle at all times to check the ticket does not fall off a window.

At no stage during the hearing did i loose my temper.

I lost the hearing with the quotation from the Judge..... "It was unfortunate that the parking ticket fell off the window into the footwell and based on your appeal and the council clearling stating a valid ticket has to be displayed at all times, there is nothing futher I can do but uphold the £50 Fixed Penalty Notice"

"This disision is final".

What i want to know is........

What happens if i dont pay?

What happens if i send a letter with my cheque, saying I have money problems, please accept this £1.00 as payent untill next month (and i do this 50 times)?

What happens if i write a letter saying I refuse the desicion and will not pay the fine?

Sorry, I cannot help as I'm not a lawyer, but thanks for bringing this to the collective attention. I tend to fix the ticket by the least possible adhesive to avoid mucky marks on the screen. In future I shall lay it on the dash top. Good Luck against the Gestapo (your 'civil' servants).

In the tin top I always just place the ticket on the dash. It doesn't help John I know but might help someone else.

If you really wanted to make an argument of it, there is probably a case against the council in that the ticket was not of the quality required, in that the adhesive did not hold it in place under normal conditions of use.

Purchase of the ticket is a part of the contract to park......Maybe you should approach Trading Standards....

Also: is there clear indication at the car park that the ticket must be displayed. If this information is ONLY present oin the ticket itself, it is not enforcable, in that you would not be aware of this aspect of the contract until you had made the purchase and been able to see the ticket...

I suspect you are on a hiding to nothing, and this could all prove expensive to pursue, but a few lines of enquiry to think about.

Yep - a common problem (tickets falling off of window / blowing across dash and onto floor before I can close the door on windy days  :mad:  :down: ).

I'm a field service engineer - until recently this was an occupational hazard.

I used to have a Skoda Octavia which was brilliant - clip on windscreen behind which you could 'clamp' tickets. Sadly my replacement car does not have this clip  :(

A good tip for all - try this (wedge ticket against screen using using windscreen demister sponge pad thingy):

Slight hi-jack, but how do you fair in the Westy. No windows at all, no roof, so fixing to the dash is pointless. I approached the local council, as all car parks require a ticket and I cannot comply.  Upshot was tough S**t don't park or pay the fine.  Surely this is not on?

What I do is buy one and stick it on the window taking a photograph. It is not a perfect answer but at least most reasonable people would agree you took every precaution.

The answer to your question (what will happen next) is that the council will issue a county court summons, they will be awarded judgement and, if you don't pay the fine plus the expenses they will send the baliff.

Whilst it's really annoying it's cheapest to pay up.

Or join the revolution.

In the Westy take a pen and write your reg number on the ticket and then take a pick with your phone. If someone takes the ticket to use it will be no good for them.

Think outside the box  :D

Roll of sellotape or one of those self adhesive poly pocket business card holder things (Clicky) and photo evidence in case of dispute  :cool:

What about putting ticket on roll bar and cling filming around that  :p   :laugh:

I like those 'pay on exit' car parks - no need to display a ticket or guess how long you are going to be....

I have just got the council to revoke a fine SWMBO got for a ticket without a sticky back, that blew across the dash in high winds.

They told me it was a good will decision and in future I should use the sticky backing ( that wasn't infect there) to make sure it doesn't happen again otherwise the fine would stay in place.

So I sent them this ......

Thank you for revoking my parking fine! Can I point out something though please? You have advised me to use the peel off backing on the ticket in future to avoid the ticket blowing about in the wind? This isn't possible as the ticket the machine is not in fact giving out tickets with a peel-able sticky backing! 

So as you say this will be a one off decision and future tickets will be enforced if I do do not use the peel-able sticky backing, could you please answer the following question?

 How can I stick a non stick sticker to a non sticky surface if the sticky you tell me to use isn't in fact there or in fact sticky, therefore rendering your stick the sticky ticket to a non sticky surface a pointless sticky remark, the only way this sticking point can therefore be rectified is for you to make the non sticky sticky sticky so that I can then stick sticky ticket to to the still non sticky surface. Until this is rectified i will buy a roll of sticky tape to stick the non sticky ticket to the non sticky surface to stop the non sticky ticket blowing around the non sticky dashboard.

And people wonder why council tax is so high! Not surprising when they have to go through all this over a couple of £ ticket!

I'm not having a go here but, everyone knows this type of thing happens (fines for falling tickets) so you ought to be more careful IMO.
