On 3rd of June I placed an order with

CARPENTERS OF YORK!

for oak flooring, I told them that I didn't want the flooring until August and gave them debit card details to pay for the goods,

For the last few weeks we have been in contact on 3 occasions to get the wood delivered, only to be told that

1/   " the boat has an engine problem"

2/   "it will be here next week"

and finally

3/   "we will ring you next week"

Just done a "Google" search on the web and it looks like they have gone under.

Can I get my money back, I presume so as I paid for it with my Credit card!

any advice would be grateful.

I hope you can. The common wisdom is that your contract is with the CC company, not with the flooring supplier and so your money should be safe. I hear, though, that as this is a sort of last resort remedy, you might have to wait for a while to get it. IMNAL... ???

You are covered by your credit card issuers, talk to them. It's extremely unlikely that you'll get your money back instantly and there will be a few hoops to jump through (forms etc) but you are entitled to your money back.

Eventually got put thru to my Debit card company and they have asked for a letter detailing all of the correspondence.

I will let everyone know the final outcome.  ???  ???

Plot thickens!

Just had a letter off them saying they have gone to the wall, But stating that anyone who has paid by card will get there money back....

Whats so annoying is that on one of the web sites I checked the company out on today, People who bought in March had the same problem, paid and no goods!

Yet they were still trading when I placed the order on the 3rd of June!

There bank is the RBS so the stand off will be between My bank and them.

If it was a debit card you've already had the dosh taken. If it was a credit card you have much more protection.

Sounds like a section 75 protection

Card protection

Best bet is speak to your card issuer.

See if you have delivery protection as well as purchase protection. All explained  in the above!  :t-up:

Andy, if you paid by DEBIT card and not CREDIT card, unless your bank has a scheme you will not get your money back from them. A debit card will be seen as the same as paying by cheque.

I may be wrong but as i understand it the section 75 only applies to CREDIT cards.

Also, to clarift this, if you paid by DEBIT card the money will appear as a payment (debit) on your bank statement.

Ah I Missed the debit card bit I thought it was a credit card transaction  :down:

Sounds to me like they were trading insolvently which AIUI is illegal, so I'd be badgering everyone. You bought in good faith, their trading was less so...

Blatters, most companies that go into bancrupcy have been trading illegally.

Problem with UK law is that it needs someone to sue them for it and who's going to spend that money when they know there's no chance of getting it back. It requires an act of parliment to make it the Govt's responsibility to police this and hand out very severe penalties to the first 20 offenders. Then it will stop, well at least slow down.
