Evo,s 7SE Posted January 31, 2010 Posted January 31, 2010 have bought a dvd recorder and hard drive recorder from argos .it is exempt from there 30 day guarentee . the problem is you have got to turn the f*ckin thing off to record anything with the timer .i want to return it and get a refund .how do i stand im expecting them to say we can only exchange it if it faulty .if the hard drive is turned off you can then only watch analogue 5 f*ckin channels i have only had the thing a week and am £200 worse off and got something i want to smash to pieces with the hammer . its like going back 25 years like you had to do with vcr.please excuse language as i am a bit miffed Quote

The Argos T's & C's don't help much, so I'm thinking that there may be something in the product description that you could use under the Sale of Goods Act. For instance, if it says you can watch one channel whilst recording another, but that function isn't possible, then the goods aren't as described... Quote

Scroll down to the review from Mark from Manchester Looks like turning it off to record is a "feature" and if so, then it'll need to be faulty to be able to return it. Is the DVD drive noisy when a disc is inserted? That seems to be a recurring theme... Quote

Richgm Posted January 31, 2010 Posted January 31, 2010 I'd argue that the fact that the description doesn't tell you that the box has to be turned off (rendering it unusable) to use the timer means it's not as described. It does say it has a "7 day electronic programme guide," indicating that you could record any program within the next 7 days. Which means you would be unable to use it for up to a week at a time if you set the timer. Quote

The only think I can think of is to take it back and quote this bit of the Sale of Goods Act. I think most people in this day and age would consider having to switch off a HDD recorder in order to use the timer function to record a programe is not really reasonable, especially given the price of the unit. I wouldn't use it as my first option though. May be worth caling the card company first and asking about the Sale of Goods act as I have quoted and asking their opinion... Quote

Man On The Clapham Omnibus Posted February 1, 2010 Posted February 1, 2010 Of course it may have changed with Walmart's acquisition of ASDA but I have found that if you take it to the customer service desk (an oxymoron if ever there was one) and choose a minion to deal with the query, you simply have to say it is faulty - even after 11 months of ownership in my case - present it in its original packaging (looks like you've only just opened it) and they'll give you a refund with no trouble. The more senior the person you deal with the more aware of your (lack of) rights they are usually. Sometimes it backfires and they just refuse and you are then left with them calling a manager or under-manager but unless they've taken note of your name etc., you haven't lost any advantage. Quote
