philfarey Posted January 14, 2010 Posted January 14, 2010 Afternoon all; I got caught speeding so I filled out my forms, wrote out the cheque and sent my licence. About 3 weeks later it came back, the counterpart and the card were different. Because of Christmas, I left it until the New Year. I then rang the Nott’s ticket office to tell them I needed to get a new licence, but the same day I rang they had passed it onto the courts. It was totally my fault for dragging it out for so long, but I was just wondering how much more damage I’ve coursed (It was a £60 fine and 3 points)? I really don’t want any more points...and going to prison for 50 years isn’t appealing. Quote

My paper part (counterpart) and photo card were different, they have different issue numbers. for this reason they sent everything back with a note telling me they needed to match. I had my wallet stolen so got a replacement photo card and counterpart, instead of disposing the counterpart I already had, ive somehow misplaced the new counterpart leaving the new photo card and original counterpart. So when they sent everything back, I ordered a new licence (both card and counterpart). Heres the problem I rang yesterday to say i had my new licence, but because it was over the 30 days notice to return the correct licence, form and cheque. They told me to keep hold of everything and that i would recieve a letter from the courts. Because I went over the 30 days and the courts are dealing with it, are there going to be extra penalties? waggledance Posted January 14, 2010 Posted January 14, 2010 One of my sons had a producer from the Police and He got 3 points for cutting down the middle of the road passing stationary traffic on his motor bike. When he sent his licence to DVLA he did exactly the same as you .... " wrong halves of a licence. They sent it back and he tried again. In the finish they made him get a 3rd licence and photo card. Now all the old ones are destroyed. As to the court side of it i dont know. Quote

stephenh Posted January 14, 2010 Posted January 14, 2010 I think you go back to the fixed penalty office and ask if they can withdraw the court summons and reconsider, to deal with the matter as a fixed penalty case; and explain to them exactly how it came about. It may have gone too far for them to do that. If so then you write and plead guilty to the court when you get the summons, and explain to the court what happened with your licence and why it couldn't be dealt with as a fixed penalty case. The court can impose more penalty points than the 3, but probably wont as long as you have made it clear that it wasn't deliberate on your part that you had the mix-up over the licence. As to the fine, the court may have simpathy and pitch it somewhere near the fixed penalty, or they may take the view that you were to "blame" for the mix-up and increase the fine. You'll have the victim support contribution to pay, and a small amount in court costs. Of course, I'm assuming you weren't excessively over the limit. Quote

Peaked my interest too. I spend half my life overtaking stationary / slow traffic in this way, and so do coppers on motorcycles In London, it's pretty much the only way to make progress in the rush hour or at any time inside the C-Charge zone. I'd be interested to hear more... Quote

(I moved house and sent my license to DVLA for change of adress so couldn't produce in 7 days when caught for speeding) Some forces have a Zero tollerance so you will likely go to caught. However advice from a friendly magistrate (mother in law) is to plead guilty but write some mitigating circumstances. 95% of the time you just get 3 points and £60 for the speeding offence. Quote
waggledance Posted January 15, 2010 Posted January 15, 2010 Sorry i missed out the important point. My son Filltered down the centre of the road over a Pelican crossing and passing the police car in the line of standing traffic also he only had his front L Plate on the bike. Quote
