We split up in August, she then stopped me getting all my stuff from the house we shared including the half built westy. I involved a solicitor which ment I could get my stuff, but she removed the westy from the work shop it was in and has hidden it some where else. She has been demanding money for its return or is threatening to sell it. What I would like to know is how much in the present climate it is worth? The car as it stands consists of:- sei wide chassis cat wide track bones and rack westfield cast uprights and c bodywork fitted brakes in stalled and working steering installed diff, prop, engine(XE) and box loosely installed fuel tank and pipe work fitted What is not included is parts to finish, vin plate or bill of sale. carpetstu Posted January 10, 2009 Posted January 10, 2009 If you have a receipt for the parts / car purchased to date and in your name, I would be making a telephone call the the local police and reporting it as theft! Maybe she might have a rethink then and return it! Even if you don't have a receipt I'd still consider this as an option, or go one better and do her for blackmail! Quote

RichP Posted January 10, 2009 Posted January 10, 2009 Can you not offset it's value against other things in the house such as furniture, furnishings, her daily drive, etc? Put a claim against something of equivalent value that she does really want and negotiate the westy as a settlement? She'll claim she's entitled to half of everything, but so are you. Quote
cleowuss Posted January 10, 2009 Author Posted January 10, 2009 Hi all Thanks for the comments so far, the position is, when we split I was asked to leave, the house is rented, the furniture I dont want, the only things I could have taken were her dogs (5 german shepards all with good german blood lines) but I had nowhere to put them and could not afford to feed them. I still have some legal avenues to follow which I am willing to use, but she keeps telling me she will sell the car if we dont settle soon. All I would like is a price for the car in the state it is in then I can make her an offer and get things sorted. scruffythefirst Posted January 10, 2009 Posted January 10, 2009 Without a bill of sale or reciept for the major components and a letter from yourself stating that it has been amateur built upto this point, its is worth very little as SVA will be nearly impossible. I'm trying to get an SVA for a part completed kit I bought, and VOSA want receipts and all sorts of declarations from the previous owner. Fortunately he's being very helpfull. So as a car its not worth much, as parts its probably worth more. Quote

scruffythefirst Posted January 10, 2009 Posted January 10, 2009 Well how much can you afford, and what does she think its worth? If you add up the costs of replacing it with new stuff thats the maximum its worth to you, as you could just go buy a replacement. Obviously its not worth that much to anyone else, as parts its probably worth 1/2 - 2/3rds the purchase price. As a whole car its probably worth a grand or 2 at most, unless the buyer wants to break it for parts. The other option is to make her a low offer, if she doesn't take it let her sell it and get a wscc member to buy it for you when she sells it. Quote

Sell the car to someone you know for £800 and give £400 to the ex partner. When everything has been agreed and settled buy your part finished Westfield back from your mate for £800 and it is your's to finish. Any good? Quote

carpetstu Posted January 10, 2009 Posted January 10, 2009 UK law says the dogs are part of the split and are valued the same way you would value the settee or tv. So value the dogs and claim half! You say your not bothered about the furniture etc but they carry a value, claim half. Or tell her return the car and you may be convinced to drop some of the settlement. If she puts the car up for sale she will need to release its location to allow viewings.....I'm sure a WSCC member can be arranged to view it and tell her how very little its worth. Quote
