Jan Coombes Posted May 1, 2007 Posted May 1, 2007 I've just had a phone call from a neighbour of a flat I rent out, telling me there has been a car dumped outside the block. It has been there for 7 weeks she’s left notes on the car and even found out who it is registered to, went round to see them but they don't live there any more. The police and council are not interested as it is on private property and it's not blocking the road or pavement. As it has no Tax on the car, if I can some how push it on the road or block the path, it should be there problem. But if I put it there is it my responsibility or the car owners? Any ideas Quote

oioi Posted May 1, 2007 Posted May 1, 2007 value of scrap is quite good at the momkent. phone a scrappy and see how much they will pay you to come and collect. mate got 50quid this way (on a car he owned). might be some issue of ownership but if its on your property... Quote
steve_m Posted May 1, 2007 Posted May 1, 2007 Push it onto the road, off your property, you can't dispose of it or sell it or even damage it because it's not yours, but you can push it on to the road then the owner will get a fine too boot plus the disposal fee the council will charge. Even if he complains that somebody pushed it onto the road and even if somebody saw you doing it . . . . the plod and council will not be the slightest bit interested, it's his car, his responsibility. Liam Posted May 1, 2007 Posted May 1, 2007 Hmmm. I would exercise caution:- Highways Act 1980 Section 149. Removal of things so deposited on highways as to be a nuisance, etc. (1) If any thing is so deposited on a highway as to constitute a nuisance, the Highway Authority for the highway may by notice require the person who deposited it there to remove it forthwith and if he fails to comply with the notice the authority may make a complaint to a magistrates' court for a removal and disposal order under this section. (2) If the Highway Authority for any highway have reasonable grounds for considering- (a) that any thing unlawfully deposited on the highway constitutes a danger (including a danger caused by obstructing the view) to users of the highway, and (b) that the thing in question ought to be removed without the delay involved in giving notice or obtaining a removal and disposal order from a magistrates' court under this section, the authority may remove the thing forthwith. (3) The Highway Authority by whom the thing is removed in pursuance of subsection (2) above may either- (a) recover from the person by whom it was deposited on the highway, or from any person claiming to be entitled to it, any expenses reasonably incurred by the authority in removing it, or (b) make a complaint to a magistrates' court for a disposal order under this section. lukeyboy Posted May 1, 2007 Posted May 1, 2007 Push it into the road and leave it for a few weeks. The council has to be satisfied that the car has been abandoned and the owner has not gone on his hols. A notice will normally be displayed on the window for so many days and then the car is taken away to the scrappers. They keep it for a bit then it's there's. Rules probably vary up and down, but where we are the scrapper takes it away FOC and obviously he gets his payment from breaking / scrap value. Tell them it must have been those pesky kids Quote
