yes they are. I used to be a credit controller for a large company and we were told that it was pointless to take a private individual to court, as we would never win.

I would say, threaten to report them to watchdog, rogue traders, thigns like that. Again speaking from experience, I have seen decisions change very quickly when external sources get involved.
