oioi Posted May 1, 2005 Posted May 1, 2005 maybe a strange question but here goes i owe a company some money (about 2500quid). i have some suspcions that the company has gone bust/is trading under a different name. how do i find out and do i have to pay them? Quote
the bear Posted May 1, 2005 Posted May 1, 2005 You would be down as a trade debtor and therefore if there if the company is in receivership the receiver will still expect payment for the goods or services provided. If the company has just chucked it in and closed the doors you may be lucky but you should do 2 things. 1. Make sure you have the money as receivers are not patient people. 2. Wait till you are asked for it. After about six months you should be OK. Quote
leighc Posted May 1, 2005 Posted May 1, 2005 If you have had goods from them, and they are trading again and try and get money off you, make them provide you with signed POD's and make them prove that they are the old company you ordered off. As has been suggested, play hard ball down to the wire, chances are that you'll get away with it. Big companies are notoriously bad at paying smaller companies for this reason. They have loads of stuff from them, stall on payment for ages, small companies goes and hey presto, they dont have to pay anything. Quote
NEW SS1 Posted May 1, 2005 Posted May 1, 2005 Your 'contract' is technically with the old company not the new one. So unless they can prove they are from the old company and that you are listed as a 'debtor' you could be onto a winner. If they contact you by post then the thing to look for is a recorded delivery that you have to sign for.. then they know you have received the letter.. and it could well contain a summons or something that they need prove of you receiving. A Ltd company can change its name but it will still have the same company reference and be the same company. Just like if you change your name by deed poll, you are still you IYSWIM. Quote

This will state whether the company is dissolved or has had a liquidator or administrator appointed and will give the name of the person appointed. Just let me know the full name of the company and I can do this for you within the next 24 hrs. This is information within the public domain so there is nothing secret about it. Quote
