harky Posted October 28, 2003 Posted October 28, 2003 on saturday i parked the westy on a resurfaced stretch of road which had not had the yellow lines repainted yet. along comes the very arrogant traffic warden who proceeds to put a ticket on the windscreen. i went over to challenge this and was told that although there are no lines there it is double yellow road and the ticket was justified.now i am not 100% sure but this must be total b*****k*. does anyone know what my legal rights are on this as i find it hard to believe that a vehicle can be given a ticket when there are no lines present. more info required, please help cheers Quote

Warden was probably just trying to meet an arbitrary quota and, in any event, won't be swayed by any of your arguments because they enjoy the brief power trip they get whenever they're able to be stubborn and unhelpful.... Snowy Posted October 28, 2003 Posted October 28, 2003 Yes, I challenged something like this a while back, backed up with a photograph... Being a public road the highway code applies, and the signs must be obeyed. No signs means you can park there. The question I would ask is that are there any other signs that indicate that this is a no parking road. Signs on the lampposts etc? Get a camera and take a picture of the place before the new lines are painted.. Cheers Quote

Rob Navin Posted October 28, 2003 Posted October 28, 2003 A local guy on the news a while ago appealed and won an overturn on a ticket as there was not an end line painted on the lies as shown in the highway code. The same goes for lines that are broken up on cobbles and things. They have to be as shown on the highway code to be legal or they could mean anything. Not sure a cheeky letter will get the best out of the authorities though. I would be tempted just to explain the facts and request a response Best of luck. Quote

I think the guy Rob mentioned was on a bit of a crusade but still managed to get about 20 such offences overturned purely on photographic evidence of nonacceptable road markings, ie no end stop. When I questioned the warden about it he actually agreed that if I appealed I would probably get let off,so the question has to be asked,why put it on in the first place. The hassle of getting photos,writing letters and having to deal with these idiots is almost enough to make you just pay up and get on with the rest of your life. Somebody should be monitoring these the parking officials to put a stop to these power hungry parking attendants. Anyway,I have had my rant and actually do feel better for it. cheers.......... Quote

Karl Woolf Posted October 29, 2003 Posted October 29, 2003 I got a ticket for parking outside the local chinese takeaway last year, and admittedly it was on zig zags but it was 9:30 on a sat night. Anyway, a large part of markings in front of my car had been removed by roadworks so took picture, wrote letter, standard response back, if I wanted to argue the point had to go to court no discussion So long story short, clean license, day of work cost more than the fine etc let it slide 3 points and £60 fine. Unfortunatley 6 months later got pulled by unmarked police car speeding So now have 6 points and my car insurance has gone up by 20% and as I`m a named driver on the wifes policy thats gone up 20% too So 40% car insurance hike for 4 years = £1000 Don`t mind the fines its the points that screw you Quote
