As has been said, DON'T go with the No Win No Fee sharks. If you are wanting to pursue a claim then do so through a proper solicitor or your insurers.

I really don't want to comment on the rights and wrongs of claiming for injury, save to say that I have been on the receiving end of several bike accidents, and the pain can be very real, and very long term (I have a permanently damaged left hand as a result of one accident, such that it has never worked quite as well as it should when doing some tasks. Bones, like cars and bikes, are never the same once they've been crashed...). The psychology of accidents shouldn't be uderestimated either.

I think Jan has a legitimate claim for legitimate injuries, and in these cases we should trust to the judgement of the legal system who do have a set of tarriffs to work to when calclulating compensation for these sorts of things, rather than just plucking numbers out of the air. IME (and I've had a bit...) the legals and insurers have got it pretty well sussed when it's a non frivolous claim.

Blatman's advice is spot on. I'm a solicitor but don't do any civil work. A claims company will simply refer you to a solicitor on their panel and take a cut. You should go to a high street firm directly. You should be able to get advice and representation on a no win, no fee basis.

Or are you suggesting that if you're killed in an accident, and blame was proven to be attributable to a third party that you'd not expect your family to be compensated either?

I agree with you on a lot of the petty claims that are made, but I do think a broken bone is a real injury.

I think it's about time the no win no claim cowboys were regulated, it's just blatant exploitation, and it makes genuine claimants seem as bad as the rest.

People who are legitamitly injured in accidents which are not in anyway their fault should have out of pocket expenses paid plus a figure in compensation. People who are at fault in anyway should not.

My next door neighbour used to work for a company who ambulance chased, the conversations from them were always geared to pushing up the claim, under £2000 they are not interested, so they ask question in a way that will get a correct response eg "since the accident would it be true to say you are afaid of driving a little" or "do you have to take a different route home from work to avoid the anguish of seeing the accident spot" "are you unable to perform sexual activities the same as before" these then jack up the claim to a level that warrents their involvment.

He has now gone to work for the insurance industry catching out fasle claims, they now set investigaters on for every claim over £20000. He tells of the proffesional actors who are wheeled in in chairs as they cannot walk etc who when shown videos of them running climbing etc still claim injuries. They usually stop when the words police fraud and jail are mentioned. Claim by all means but only for truthful matters as others have said we all pay in the end.

Need to find a standard can for my bike before it goes in to be looked out.

Probably not the best time or place to mention that, insurers get one whiff of un-notified mods and its a case of you lose :oops:

The non standard can would not make a material difference to the cause of the accident, only the possible amount of payout, as you can't expect them to buy something that may not conform to Construction and Use regs...

And yes, Jan is a first class plank for making it public, as is anyone who divulges material facts which may be in breach of an insurance policy agreement on a public forum. Lots of people do it, and it amazes me every time...
