Legal Advice Please

Having dealt with damage claims myself when I was working with Openreach, it would be the original utility company that instigated the site works.  No matter who was sub contracted to actually carry out the works,  the utility who commissioned the work is responsible. Reason being is a large National Utility does not want negative publicity from the public or press and would  settle the claim through their public liability insurance.

A smaller claim would be dealt with by a local office.

If no one takes on the claim then it's time to seek advice from  Citizens Advice.

One thing that might trip you up is if the workmen actually on site asked if you could move your car a suitable distance to avoid damage, whilst they working in close proximity.

Just to bring things up to speed on this one, the legal opinion was that Company C are liable, as the contract to do the work was not between Companies A or B and myself.  If I had been in a contract with them, Company A would be liable.  I've filed the claim against Company C today online, very easy, and they have three weeks to respond.  Wish me luck!
