Mike Posted March 22, 2003 Posted March 22, 2003 just wondered if this has happened to any one before. most prob has. was coming into the car garage today to fill up my tin top when some stupid women kicks her car door open as i went to go past, which meant i hit her car door with my front bumper. as soon as it happened she said sorry she never looked, but her b/f came down 2 mins later and said it was my fault for goin to fast even though i was goin really slow through a gap. should i go through the insurance? i already pay enough insurance as it is! who's insurance policy does the claim goto? any advice would be much appreciated. mike Quote
Thor, God of Thunder Posted March 22, 2003 Posted March 22, 2003 ....don't worry, Mike, it's a no-brainer. The woman's at fault for opening her door without checking. Her moronic boyfriend is talking out of his and I hope you gave him a good slapping for his impudence. Your speed (or the lack of it) in this situation is irrelevant. Sue the nunney and rest easy. Rusty Nuts Posted March 22, 2003 Posted March 22, 2003 i think on the road u r supposed to leave a gap of four feet between parked cars but if u was at a crawling pace in a garage the women should have to be just as carefull because these places can be a tight squeeze i would try to prove her careless and opening her door without due care and attention i know from personal experience that if u stick to your guns and there are no witnesses then u stand a good chance if u strongly feel u was right try to get the cctv camera footage from the forecourt (or even if u dont think u was right b4 evidence falls into wrong hands) sorry u have had this experience they r not the easiest of things to sort at the best of time best of luck shindha Quote
Guest Posted March 23, 2003 Posted March 23, 2003 IMO - She said "sorry", In law this is an admission of guilt (I think). Case closed! Quote
Chris Elworthy Posted March 23, 2003 Posted March 23, 2003 First thing to do is just tell your insurance exactly what happened. Don't discuss it with the third party. The insurance companies will decide.(if your insurance policy covers you on private property which nowadays it should) If the repair costs on either side are less or equal to the excesses, then you will probably have to agree with them who was to blame. On the public highway the blame as I understand will nearly always err towards the moving party, ie the person driving not the person opening the door. Stupid I know but apparently thats how it is. How badly is your car damaged compared with theirs ? Quote
