If a product looks identical in appearance to another's when observed by the "man on the ..."etc., then it's a copyright infringement. I'm no patent lawyer but I just like the concept of the typical citizen being, as you describe, in a mac, wearing a flat cap, and having a Daily Mirror rolled up in his mac pocket, travelling home to Peckham on the eponymous bus.
