"A Scottish judge is being asked to consider whether Boris Johnson could be jailed if he takes the UK out of the EU without a deal.

A legal challenge is to be heard at the Court of Session about whether the prime minister could be forced to delay Brexit if no exit deal is agreed.

 

The court case seeks to establish what might happen if he refuses to act.

This could even include the court effectively signing a letter to European leaders on behalf of Mr Johnson, asking for a fresh extension.

 

The legal action has been initiated by businessman Dale Vince, QC Jo Maugham and SNP MP Joanna Cherry.

They want the Court of Session to rule on the extent to which Mr Johnson is bound by the legislation passed by opposition MPs - the "Benn Act", which requires the government to request an extension to the Brexit deadline if a deal has not been signed off by parliament by 19 October.

 

Lord Pentland will hear arguments on Friday about what the consequences of the prime minister not doing this would be, with the petitioners suggesting "penalties including fine and imprisonment" could be applicable.

The judge will rule on this initial part of the case on Monday, after which a panel of Inner House judges will consider whether the court could use its "nobile officium" power to effectively sign a letter to European leaders if Mr Johnson refuses to do so".

 

From the comments section I had to laugh at....    "Boris doesn't need to go to gaol. Parliament is a very progressive employer these days, so if he feels unwell he could be off sick for a few days. Or maybe he could take paternity leave - God knows he must be entitled to some".

 

If the Courts take over, at the behest of wealthy clients, there will be no need for a Parliament at all.

"After five hours of talks at a summit in Brussels, the UK and the EU have agreed a "flexible extension" of Brexit until 31 October".

 

Parliament seeking an extension when they have not agreed on any plan is just 'kicking the can down the road'.

No need for that in my view. Every scottish council voted remain so yes of course they are going to look to obtain a deal. Just like the 'English' would if it were the other way round.

 

This  country is divided enough without generalisations of 'you Scottish' or 'you English'. 

 

Boris and his puppet master have brought all of this on themselves. Their aims are good but their tactics have been dreadful.

 

And dont forget one thing it was the English supreme court who had the last say on this before you start throwing stones north of the border.

And the most ridiculous thing is that 2 out of the 3 people who've brought this to court are actually, wait for it........

What seems ridiculous thing to me is why are they having the hearing in Scotland? Is it because the Scottish court has proved itself to be less than impartial due to the vote in Scotland to remain?

 

You are right we are divided more than ever before and having the will of the majority ignored by using every possible trick has become tiresome. They have tried to say the leave campaign was corrupt and that Arron Banks was guilty of all sorts of criminal acts and yet there has been nothing found and every investigation he has been found innocent.

 

In parliament it appear the SNP are really trying to secure not a brexit of any description but yet another independence vote and are willing to do a deal with anyone except the Tories to do just that. It is sad that wedges are being fashioned and driven between us

You'll forgive me Steve, Is my understanding correct that the Scots want to keep us in, then have an independence referendum?    That would leave an England and Wales in which the vast majority of constituencies voted leave, stuck in! 

 

Seems daft, why all this talk of an independence referendum when you don't know what you would be getting independent from.  If the Scots think Brexit is daft , as 130,000 Scottish jobs depend on the EU, why would you then leave the UK , upon which 560,000 Scottish jobs depend. How would anything you make get to the EU without crossing two borders? 

 

Some people think Brexit is daft, Scottish Independence is madness on a whole new scale, 300 years to undo: 

  • A currency union with the rest of the UK would leave fiscal policy in the hands of the Bank of England - not independent, Adoption of the Euro will leave Scotland's budget being subject to approval by the EU - not independent (Public spending in Scotland is about £1,600 per person higher than in the UK as a whole, while tax revenues are around £300 per person lower- the EU would simply not allow this) 
  • An independent Scotland would need to apply to join the EU, The UN, NATO, The WTO
  • An independent Scotland would need to establish (and fund, set up IT and other systems for) 200 new public bodies to perform functions that UK bodies currently perform.

 

I am truly stunned that it is even spoken of.

I dont think that's the general consensus amongst the real people of scotland (but can only speak of the people I know). But if you speak to some of the hardcore SNP followers then yes. A no deal brexit would trigger calls for another independence referendum. Which in my lowly opinion would be a complete disaster as I rate Sturgeon on about the same level as Corbyn.

 

I personally believe a negotiated exit would put any further independence referendum talk to bed for a long time. But now I see that Wales are calling for a referendum within 10 years. The place is falling apart when we should all be pulling together. 

 

But when the people at the top are more interested in bickering then they aren't exactly leading by example.

There a lot of people making a lot of noise at the moment. There was a march in Cardiff recently which was the usual shouty sort, however in the very latest polls only 12% wanted to be independent, which spookily is the same % of people who voted for Plaid Cymru yet they make proportionally a lot of noise. Economically Wales would have less chance of standing on their own than Scotland.

 

There is no doubt that a negotiated exit is best, the reality is too many do not want one and any deal that means we cannot do deals with other countries would not be acceptable to many.  Boris is a clown sometimes but at least he is actually trying to break the log jam and all opposition parties are doing is throwing more logs

But where did they bring the info to? A Scottish court - because they dont belive in Brexit

That is very interesting and explains why when asked, the Brexit team have a smug look on their faces and say that they will abide by the law
