What to do?

Hiya, I bought a set of used but remanufactured shocks off a car forum but one thing led to another and I never even got chance to fit them, so flogged the on eBay (using EXACTLY the same description as per the original advert) A month later, the eBay buyer messages me saying they have failed and wants me to pay for the repair

I have no reason to doubt that the person I bought them from is being honest, but I'm not sure I am required to fix this for them, they are used but professionally remanufactured shocks, is this my problem to resolve? I'm not a trader, just a regular joe...

What do folks think?

As above,if described as used and no warranty the buyer accepted this by placing the bid

Common sense says you're absolutely fine. Slight nagging doubt because it's eBay though and they are seemingly a law unto themselves. Have a quick read of their terms & conditions.

And that's my point right there, they have "buyer protection" that covers you for everything, but surely they can't enforce something that's not legal???

The problem is they control the funds too. They can make your PayPal account go negative but what happens from there I've no idea. I'd empty any funds from your PP account then politely decline the refund request. Did they leave feedback seeing as it was a month ago?

I had an issue whereby a dispute wrongly favoured the buyer - ebay refunded them from my paypal account

So i called paypal in Ireland and explained the situation and the gave me my money back

Just had an issue with a wireless camera like that - I used it, it was fine, the bloke on the other end was unhappy so I let him send it in to eBay's dispute resolution team and they judged in favour of the buyer. 

 

Nothing I can do, they instructed him to send it back, I had to issue the refund. I've paid 2 lots of postage, transfer fees and have a camera to ebay on again. Not happy but such is the big bumming that is ebay. I'm moving over to Gumtree from now on with ebay's extortionate fees.

Mine was a surround sound speaker that wasnt the colour that they thought it was

The buyer seemed like a really nice lady buying it for her hubby

Ide had loads of interest in it and figured ide be nice and say return it and ide just cancel the sale and put it on again

I received it smashed to bits so told them i couldnt refund as it was scrap and for them to claim off parcelforce

She went berserk,accusing me of being a con man

Note to self - dont be nice :)

I am intrigued, when you say you sold 'a set' do you mean two or four, and how many have failed?    I find it difficult to believe that multiple shocks have failed at the same time unless inappropriately used.

 

I think a whole month when you have had no control over how they were used is too long for you to feel, or be held liable. 

 

I might, in the spirit of Ebay, try and get a feel for how genuine the buyer is (what feedback and how much business) get photographs showing the failed shocks, identify what the shocks were used for, and perhaps, while insisting that you are under no obligation to do so , discuss meeting half way. 

 

I could really only go on gut feeling, have you been taken for a ride when you bought them?  if not why would they fail? 

 

Decide what you believe is right, and do it,

We will all be interested in hearing how this turns out. Personally I am getting more concerned that eBay just takes the buyers side.

It really does. No comeback from the seller or your chance to put across your side.

 

You pay fees and postage on your end, then ebay make you pay the postage back at the buyer's chosen rates and charge fees again. It's a swizz I tell thee
